all have their life vests on. the groom to be was taking it all in stride. >> we were on a boat and we hit a rock and it was a big jolt and then all of a sudden the coast guard boat came and then we got off and all the coast guard guys saying all this crazy stuff and the guy is chest deep pumping out all the water and not giving it good odds. we're like, okay. >> the cause of the mishap on the water is under investigation. the san mu dayo county coroner will perform a biopsy on a high school teacher to determine how he died. the body was found near crystal springs reservoir. a redwood city resident, ryan's sister reported him missing on tuesday. his car was found near the reservoir on wednesday. grief counselors were in yesterday to talk with students and staff. san jose police say they are making headway in the fight

against gang violence in the city. this week, they've arrested 17 people in connection with four homicides, three gang-related killings this year and a shooting last year. four of the suspects are juveniles and not pictures here. new details this morning on what could be the largest disciplinary crackdown on officers in oakland police department history. the police chief recommended dozens of officers be reprima reprimanded including suspension and termination for their handling of the "occupy oakland" demonstrators. it report comes as the department is already under scrutiny facing a possible federal takeover. janelle wang has the story. >> overall, i think it's very good news because it kind of shows that maybe opd has taken a step in the right direction. >> reporter: iraqi war veteran scott olsen is reacting to the report released by the oakland police department. the report says that recommending that two officers be fired for using excessive force and 42 others disciplined

or suspended for their actions during "occupy oakland" protests. olsen was critically injured during the protests last october. he is suing the city of oakland. >> i went in with a very skeptical mindset and this is, in some ways, proven that they are taking the right action as. >> reporter: the report says rules were broken during "occupy protests" on october 25th and november 2nd last year and on january 28th of this year. >> it never looks good when the police don't follow the rules. we hold the public accountable to the laws and then, therefore, the police department has to hold our own officers accountable. >> the broken rules include acting inappropriately, using excessive force, refusing to provide a name and making false arrests. this report outraged the president of oakland police officer's association. >> these officers never chose to geout and have to choose to deal

with "occupy." >> this went through their peers and went through a chief who is not an outsider, somebody who came up the ranks of this department and he knows these men. these men and women. >> that was janelle wang reporting. two bay area law students are behind bars in las vegas this morning accused of killing an exotic bird. police arrested eric cuellar and justin teixiera. they were caught on video abusing a fowl at the wildlife habitat. the animal was decapitated. both men are facing charges of torturing and killing an animal. pg and are preparing to pay up. pick up the lion's share of the $2 billion tab for overhauling its gas pipeline.

after the deadly san bruno explosion in 2010 billing its customers for 85% of the costs, but on friday the state public utility commission tentatively ruled the utility will pay for just, will pay for two-thirds of the upgrades and consumers just for the other third. the final decision now goes to the five-member commission. now, to our continuing coverage of the major league baseball playoffs. we now know the giants are coming home for the start of national league championship series to take on the st. louis cardinals. the matchup was decided last night after the cardinals beat the washington nationals in a come from behind victory. they tweeted this picture of tim lincecum and a few other players watching the plane on cincinnati waiting to see which direction they needed to fly. if the nationals had had won game one would have been in washington. instead, the cardinals stunned the nationals overcoming a 6-0 deficit and coming back to win 9-7. that means the nlcs starts

sunday at at&t park. game one starts just after 5:00 p.m. the giants. game two monday 5:07 before the series a moves on to st. louis on wednesday for games three and four. and games five through seven will be played next friday, sunday and monday. that is, of course, if they're necessary. meantime, the oakland a's are saluting their fans and saying good-bye for the season. >> when you lose a game that you don't think you're going to lose and you think you're going to play the next day or go somewhere else, it's a little bit difficult, but, you know, off the top of my head, i think if you look back at the beginning of the season and see what we accomplished, it was unbelievable. >> the a's fell to the detroit tigers in thursday's night decisive game five. what is nextt for the team? jimmy bean thinks he will keep most of the team in tact for the

welcome back to the program, everyone. ten minutes after 7:00. you're looking at the bay bridge this morning. rob mayeda is going to be here in seven minutes to give you an update and when 90s are hitting the forecast today. new this morning, the operators of japan's fukishima the earthquake that followed could have been avoided. tokyo power company admits it failed to take stronger disaster prevention measures at the plant in an effort to avoid potential lawsuits and protests. the admission marks a major reversal for the company which always insisted it was prepared for the crisis. a colorado family is grieving this morning for their 10-year-old girl who will never come home. officials announced last night they positively identified a body found in a park that is that of jessica ridgway. ridgway disappeared last week while walking to school in the

denver suburb of westminister. hundreds of volunteers helped in the search effort and now authorities are shifting their focus to a search for the suspect. the fbi is putting nearly 50 agents on the case to help make an arrest. wall street finishes off a rocky week, but some of the nation's largest banks are sharing some good news. cnbc tyler matheson gives us a look at this week in business headlines. >> wall street just wrapped up one of the worst weeks for the market since early june. stocks took some big hits after the world bank and the international monetary fund lowered their forecast for global economic growth. it's been a lackluster start to earning season so far, but not at two of the nation's biggest banks. both jpmorgan chase and wells fargo took home record quarterly profits. most of that was on a jump in profits in home mortgage loan business thanks to the recovery in housing. that rebound in real estate including rising prices on homes, well, the price spots in the federal reserve's latest

report of economic conditions around the country called the beige book. meantime realty track reports that foreclosures fell for the second month in a row. five-month low for that one. first time jobless claims off by 30,000 last week. 4.5-year low on that one and the labor department says more than 3.5 million open jobs were advertised during august. the same month more than 4 million americans found work. amtrak had some good news to report. the rail service carried more than 31 million passengers last year and that is the most ever dating back to amtrak's founding back in 1971. i'm tyler matheson, get all your business news on cnbc. sticking with business, best buy is doing something new this morning to get your business. the retailer says starting today it will price match major internet competitors. if you see it online, just walk into any of the best buy stores and you'll get the same price. and if they're out of stock,

they'll deliver it, for free. the electronic chain says there is one draw back. price matching won't be offered thanksgiving week or cybermonday through christmas eve. speaking of online shopping according to a study off aering customers free returns can increase spending by more than 350%. researchers track customers habit to two leading online retailers for more than two years. they found spending per customer increased by more than $600 at one site, $2,500 at the other. after the retailers introduced free shipping for returns. now, here's an extra incentive to take public transit for your weekend activities. b.a.r.t. is giving away free ice cream to riders. part of the 40th birthday celebration. ice cream handed out at the castro valley and fremont stations this afternoon from 1:00 to 4:00 p.m. b.a.r.t. is seeing an increase in ridership this year, including one of the busiest

tomorrow night. we now know sunday night at 5:00 is when the giants post-season continues. they're going to host cardinals in game one of the nlcs. now, farther south in los angeles, it's known for its notorious traffic jams, but last night it was a space shuttle that stopped cars on the freeway. as the spate shuttle "endeavour" makes its way to the california science center it has to maneuver around and across some obstac obstacles, not the least of which was l.a.'s 405 freeway. the space sthutal was pulled across the bridge by a toyota tundra pickup truck. later today "endeavour" will face more obstacles as it goes down a narrow residential street with apartment buildings on both sides. and it's no mistake we mentioned toyota because they took this opportunity to film a commercial for their tundra truck. rain means snow for the sierra this week. say hello to the first snowman of the year both heavenly and

kirkwood ski resorts are reporting an inch of snow fell overnight at higher elevations. not quite enough to ski on, but it's a start. many ski resorts in the sierra say they hope to have enough snow to open by early next month. i wanted to tell you i was driving south yesterday and the way the light was hitting mt. diablo i had to look hard to make sure that wasn't snow. i knew snow was in the forecast and i had to convince myself that wasn't quite possible. >> probably a little too low, at least this early in the year. might have been some hail, though. earlier this week strong storms around gilroy and now the weather is turning much more calm as we kick a off the weekend. quite chilly where we had clearing skies and we dropped off into the low 40s this morning and napa into fairfield and 54 degrees in san francisco and in oakland and gilroy right now, 54 degrees. not much wind out there. we're seeing a ing ing a little

breeze, but not a strong sea breeze right now and really the lack of a sea breeze coming up in the seven-day forecast and help vault the temperatures up middle part of next week. here is the source of the high clouds we're seeing, a weather system that weakened as it crossed out over the bay area overnight and behind the system, the big pattern change you're going to see this ridge of high pressure that will park itself over oregon and northern california come wednesday, thursday and friday. 80s and 90s coming back. so, if you want to kind of, flip the calendar back to summer, we're going to get it by the middle part of next week. in the meantime, the weekend will see just a subtle warm up and more sunshine with morning clouds and pretty nice weather as we go through your weekend. right now the high clouds drifting on by and should see mostly sunny skies and probably the most sunshine we've seen in a few days around the bay area. 1 d 1:00 still looks okay but patches of clouds come back to the coast as we head through the evening hours and eventually as we head into tonight, we'll see the low clouds field back into the bay heading into tomorrow

morning. temperatures, mid-70s around san jose and upper 70s closer to morgan hill and areas south of san jose. south of highway 85, warmer temperatures in the santa clara valley and santa cruz not too bad, 75 degrees and 78 degrees in pleasanton and over towards fairfield and antioch and into the north bay, low to mid-70s with patchy clouds. pretty nice weekend, little bit warmer tomorrow, but the real warming is going to hold off until about wednesday, thursday and friday. from there places like livermore and pleasanton should get close to the low 90s. just a complete flip-flop of the week we just saw where we had highs in the 50s and 60s and now 80s and 90s coming back. not for the weekend, but middle part of the week. see the temperatures jumping up. weekend looks pretty good. patchy clouds, comfortable weather for the 49ers and giants games coming up tomorrow. >> exciting day. rob, thank you very much. science lovers can get an inside look at one of berkeley's most prestigious labs today.

they will open their doors to the public this morning. the open house will take visitors through the lab to see some of the projects the scientists are conducting around the world. nobel, laureate and physicists saul perlmutter will speak to visitors. meantime scientists at livermore lab are exploring new territory exploring crimes. identifying victims of murders and natural disasters. today in the bay jodi hernandez got a rare, behind the scenes look at how they do it. >> reporter: scientists at lawrence livermore laboratory are diving into new territory, teaming up with law enforcement to solve cold cases. >> for the most part, the technique is not well known because it's not part of the usual tool box of techniques law enforcement uses. >> reporter: but that may soon change. thanks to the work of senior scientist bruce buckles. buckles' research revealed above ground testing of nuclear

weapons in the '50s and '60s has left radio act aive carbon sealed into the enamel of people's teeth. by testing dental remains using a device called an accelerator, buckles can pinpoint a birth date within one to two years helping police identify victims of crimes. the technique just helped police in canada crack a case and was used to help identify victims of the 2004 tsunami. >> there were a lot of people that were out on the beach when it hit and they drowned. and they had no i.d. with them because they were at the beach. >> reporter: buckles says the technology could help investigators identify the remains pulled from a linden well, the victims of the speed killers. predicting his bomb pulse radio carbon technique will some day be as common as dna testing. >> the o.j. case that was 20 years ago, still controversial. now, nobody disputes dna

this week's vice presidential debate still has people talking mostly about the behavior of the two candidates. vice president joe biden came out aggressive attacking the republican ticket using the word malarkey and laughing, scoffing and interrupting and even flailing his arms at his gop opponent paul ryan. before the debate was even over, a twitter account launched called laughing joe. this morning, more than 30,000 followers. the commander in chief is getting help from the boss, bruce springsteen. on the road with former president bill clinton campaigning for president barack obama. the two will be in parma, ohio, on thursday for a free event open to the public. president clinton is expected to speak to the clrowd. it's not clear whether springsteen will give a musical performance. much more ahead for you on "today in the bay" an award that has been half a century in the maki making. why this 93-year-old grandmother had to wait 50 years

weather system come on by. you can see the clouds heading off to the right side of the screen, weakening weather system, that's good news, meaning it is also kind of mixing the atmosphere and breaking up some of the low clouds even around the bay this morning. temperatures starting to get in the 70s as early as lunchtime and over towards fairfield that will see mid to upper 70s this afternoon and today, certainly, the coolest day of the next seven. we have 80s and 90s popping up in the seven-day forecast and we'll show you when the big return to summer is coming in the seven-day forecast in a few minutes. >> looking forward to it. thanks, rob. murkialies police say a man and his wife arrested in washington are connected to the murder of an elementary schoolteacher, but they're not saying why. they were driving her stolen car wednesday. the washingtons are also linked to a crime spree in southern california. investigators say darnell escaped from a san bernardino prison with his wife's help and shot a police officer.

&e safety upgrades but not as much as the utility had hoped. after the deadly san bruno explosion in 2010, they began billing their customers for 85% of the costs to replace age aing pipelines. but the commission tentatively ruled the utility will pay for two-thirds of the upgrades and customers only one-third. the final decision now goes to the five-member commission. don't be fooled by an orange safety vest. police in san francisco are warning people of an alarming scam. burglars are posing as utility workers to get inside homes. the suspects claim to be water department employees who want to check water faucets or test water for possible contamination. when the residents are distracted, the suspect rips them off. we have a follow up now to a story we first broke. the postal service offering a big reward to help thieves stealing mail in the south bay.

someone breaking into community mail boxes and they break the back panel of the mailboxes and then steal the mail. the u.s. postal inspector office is offering a $10,000 reward for arrests conviction of the culprits. the post office has sent armed officers on to rose avenue and nancy lane after a report last week on the thefts. >> any time somebody attacks a mail box like that, it is a federal crime. the crime has been committed and it's serious. >> the thieves face five years in federal prison and a $250,000 fine. repairing the vandalized mail boxes is the responsibility of the landlord. delayed gratification half a century after a 93-year-old woman left san jose state university, she finally received the one thing she always wanted, her diploma. her story. >> reporter: 93-year-old olive chandler finally received here college diploma from san jose state. >> i'm going to hang it on the wall. look at it. it's beautiful. >> reporter: for 20 years starting in 1938, a compton junior college in southern california, chandler was determined to get her degree in home economics. but life got in the way. marriage, work and giving birth to five children forced her to delay her education and in 1959, at the age of 40, when she thought she had enough to graduate from san jose state, she was told she fell a little bit short, one course short. by that point, she had to raise her family and never went back to college. >> because i know how much she valued education, how hard she had worked and i knew that she had attempted several times to finish. >> reporter: as the that's why her youngest daughter wanted to do something for her mom. she contacted san jose state and asked for a letter recognizing her mother's love for life-long learning. san jose state reviewed olive's

economic record and concluded she had enough to graduate. but instead they awarded her a diploma, a bachelor's degree in home economics backdated to august 28, 1989. >> just the thing to prove i did it right, but, you know, it doesn't, i won't go out and get a job or try. >> i'm real excited. it's just a recognition of everything that she's worked for and everything that she's done for us, for her family. >> reporter: while earning the diploma can mean better economic opportunity, for olive chandler, it means so much more. >> an education always puts you in good standing, my education was used. much more ahead, a big weekend for the two san francisco sports teams. the two matchups that could make

hundreds of children every year get a huge smile on their faces, thanks to one south bay family. they hand out christmas presents to the needy and thousands of dollars in scholarships. damon truijillo sat down with the family of the year. >> reporter: a quiet, yet vibrant community nestled in the heart of the silicone valley. not much wealth here, but a lot of pride. that pride and vibrancy were challenged in 1983. the levees gave way in the south end of the san francisco bay. el niso was under water. >> everything is just ruined. everything.

we lost everything. >> it was really hard, really, really hard. and to just see all those poor little kids. >> reporter: they saw the images from their home in sunnyvale and they mobilized. >> we were asked to come out and be santa. >> reporter: joe santiago put on his santa suit that he used when visiting shelters and community center. judy became mrs. claus and, together, they helped bring the hope back to elle niso. >> all those kids had nothing and we left there and the first thing my husband said was, oh, gosh, mom, i hope some day we can make enough money to buy them a present. >> reporter: the santiagos have been delivering presents for 29 years now. four generations of the santiagos are now santa's

helpers. >> when i go to elviso i help out a lot. >> it's like part of what we do during the holidays. i don't know, no one ever pushed us to do it, i think we wanted to. it was fun. >> reporter: judy and joe were both single parents, he had four children, judy raised three. and it was not love at first sight. joe coached a baseball team against judy's son. >> i can remember one day joe came out of the dugout and she was a rival coach and yelled at him and basically told him to sit down and be quiet. >> reporter: the couple later mended fences. they married in 1975. the wagoners and the santiagos became the brady bunch. >> yeah, we were the brady bunch. at school everybody referred to us as the brady bunch. >> reporter: but tragedy struck the family in 2003.

joe lost his battle with an infection that led to kidney failure. >> i was really young when he passed. just coming here every, every year and see him dressed as the santa claus and sit on his lap and we get our own presents every year. >> i wished they had a phone up there and i'd tell him, you know, just because you're gone, things haven't changed. >> reporter: the family continues its charity work, providing christmas presents to more than 500 children every year and through its santa visits alviso foundation, the santiagos began awarding college scholarships. almost $250,000 to date, all to children who still stay in touch. >> makes me cry. they're all first in the family to go to college. a lot of them, their siblings are following and they're like

here's a live view from josh out there at at&t ballpark. the quiet it will be for the rest of the weekend. you're looking at patchy low clouds and clearing skies over the ballpark. kind of a sneak preview of the weather i think we'll be seeing as we head towards tomorrow evening. of course, the national league championship series coming to san francisco with the cardinals coming to town. we will see numbers very likely tomorrow in the mid-60s around first pitch time. coming up just after 5:00, partly cloudy skies, little breezy and very likely warmer for game two as we get into monday. so, very pleasant weather, much nicer than the temperatures we've seen here throughout much of the workweek. this morning, if you step outside, you'll probably notice the air is really quite cold. we have clearing skies in the north bay and around san jose. mid-40s to start. not much wind out there. see the sea breeze pick up this afternoon and low clouds coming back to the coast right around sunset. high clouds now leaving the bay area, this was a weakening weather system that just kind of fell apart as it moved its way

through northern california and no worries about any precipitation in the sierra. behind the system, the big pattern shift we'll see towards the end of the week, high pressure building in, almost like a summertime high. really clear out our skies and promote light offshore breezes which means 80s and 90s in the forecast starting wednesday. i think thursday, friday and saturday will be the hottest days of next week. for the weekend, clearing skies, comfortable temperatures but the real heat shows up for the second half of the seven-day forecast. futurecast showing you the patches of low clouds through mid-day. low clouds way off shore as we go into the afternoon and through the evening. few low clouds approaching the coast as you can see over my shoulder. tomorrow morning plan on patchy low clouds and sunny day for sunday. upper 70s south down towards morgan hill and gilroy and upper 7 0s today. mid-70s around castro valley and upper 60s to low 70s around oakland and the bay and today very likely the coolest day

we'll see for the next several days. temperatures coming up on sunday, may not notice the warm up between today and tomorrow, very similar days. but by monday, tuesday and wednesday, the numbers really start to go on up. 10 to 15 degrees of warming for most of our inland valleys between today and wednesday. that means some 90s coming back for the middle part of the week, thursday into friday, you'll see those temperatures in the upper 80s and low 90s and 70s out on the coast. if you missed summer, we're bringing it back for you for three to four days. >> is this what some people call indian summer. >> these roller coaster weeks where you see snow in the sierra and then a little heat wave comes back. >> great, rob, thank you very much. drinking at school. it's perfectly acceptable, in fact, encouraged. the most famous wine region, but the livermore valley is turning off top notch students of the vine. a program has blossomed at livermore's college. its even has its own 3 1/2 acre

althe alameda fair grounds deaf nation expo. you don't have to be deaf to attend, they have exhibit and entertainment for all and definitely the smiles. now this is just one of the lang wnls i have come to love. language in general is a beautiful thing. also beautiful, well, it's fall in the bay area. today at guadeloupe park in san jose, you can say it's gorgeous. the premiere ought am extravaganza filled the field today. there's pumpkin carvings, scarecrow building all while keeping in the spirit of conservation and preservation typical for the bay area. we focus on the fun while doing a little learning, too. this makes me think of trick or treating, of course. walking around, getting candy but not far from there folks are getting together to walk around for a different purpose at the

we now know the giants are coming home for the start of the national league championship series to take on the st. louis cardinals the matchup was decided last night after the cardinals beat the washington nationals in a come from behind victory. the giants tweeted this picture of tim lincecum and a few other players watching the game on the plane in cincinnati waiting to find out just what direction they were going to go. it's back home because the cardinals stunned the nationals over coming a 6-0 deficit. coming back to win 9-7. the nlcs starts sunday and game one starts just after 5:00 and the giants just announced that madison will start the game. games five through seven will be friday, sunday and monday and that is, if they are necessary. if you're heading out to the giants game this weekend, keep in mind, another ball game you have it contend with. the 49 rers are playing sunday

night at candlestick. sadly, you'll remember the giants eked out a 20-17 victory in that game. they then went on to beat the patriots in the super bowl. game time for the football game is sunday at 1:25. meantime, the oakland a's are saluting their fans and saying good-bye for the season. >> when you lose a game that you don't think you're going to lose and you think you're going to play the next day or go somewhere else, it's a little difficult. but, you know, off the top of my head, i think if you look back at the beginning of the season and see what we accomplished, it was unbelievable. >> a's fell to the detroit tigers in thursday night's decisive game five. so, what's nextt for the team? billy bean says he plans to keep most of the team in tact for the 2013 season. the oakland tribune reports bean is optimistic about the next season and thinks this team is in "great shape." bean did discuss the possibility of adding to the team, however.
